Professor Ned Foley recently published an op-ed in Politico titled, “We’ll need vote-by-mail in November and it could be a legal nightmare,” surrounding the idea that with the increasing amount of absentee ballots being submitted due to COVID-19, there will also be an increase in litigation.

“Simply put, there are more things that can go wrong with vote-by-mail compared with in-precinct voting,” Foley wrote. “And history shows that a major fight over an election’s outcome is more likely to come in the form of challenges to absentee ballots.”
