Professor Peter Shane publishes op-ed in The Atlantic concerning Michael Flynn prosecution
Professor Peter Shane, an expert in a variety of areas of law, recently wrote an op-ed in The Atlantic titled, “Flynn’s New Argument Is Constitutional Nonsense.”
The op-ed, which surrounds Michael Flynn, President Donald Trump’s former national security adviser, discusses the integrity of prosecution as an executive and judicial concern.
“The idea that federal prosecution is exclusively an executive-branch concern is not accurate,” Shane wrote. “The public prosecutor was generally a far less significant government figure throughout the late 18th and most of the 19th centuries than it is today, and most definitely not seen as an inherent bearer of executive power in 1789.”
