An expert in the area of election law, Professor Edward Foley recently published an op-ed in The Washington Post titled, “Prosecuting Trump for the Capitol riot will be difficult — but not impossible.”

“One potential avenue of criminal prosecution — charging Trump with inciting insurrection — raises serious First Amendment concerns. A second — charging him with participating in a ‘seditious conspiracy’ — would avoid those issues but would require evidence, yet to be established, of Trump’s involvement with a subversive plot.”
