Shane writes op-ed for Bloomberg BNA

Peter M. Shane, the Jacob E. Davis and Jacob E. Davis II Chair in Law and an internationally recognized scholar in administrative law, wrote an article for Bloomberg BNA about congressional attacks on FCC-White House links and net neutrality.

“White House policy engagement with a rulemaking process–unless it seeks to usurp an agency’s statutory decision making authority or to induce a regulatory decision based on legally irrelevant or impermissible grounds–is not ‘improper influence.’ In contemporary parlance, it is a feature, not a bug in the operation of the administrative state,” he writes.
