With COVID-19 cases increasing in Ohio, Columbus Mayor Andrew Ginther reinstated a mask mandate in city limits, which was followed by a handful of other surrounding areas.

An expert in the area of health law, Associate Professor Micah Berman was quoted in an article by The Columbus Dispatch titled, “Ohio lawmakers restricted local mask mandates. So how are Columbus and other cities able to pass them?

“The state legislature doesn’t have the power to just say ‘no’ to laws it doesn’t like – it has to develop its own legislative approach if it wants to displace local law,” Berman said.

“Here, the legislature has clearly shown it has no interest in developing a comprehensive plan to contain COVID. At the very least, it should stay out of the way and let cities take the actions they feel are necessary.”
