Health Law and Policy

Health care is one of the most regulated industries in the world, leading to a host of legal and bioethical questions. With the recent passage of comprehensive health care reform, it is also one of the fastest-growing areas of law. health care practitioners need a strong foundation in business law, administrative law, and torts.

The core course for this academic area is health Law. This course focuses on selected issues in health care and clinical research; professional relationships in health care; the obligation to provide care; medical malpractice; health care privacy; end-of-life and other ethical issues; the business structure and regulation of the health care industry; health care fraud, abuse and antitrust; and the regulation of clinical research.

Advanced offerings, such as Law and genetics, provide an opportunity to examine the process by which law responds to rapid changes in scientific knowledge and technology and also the ways in which law affects the course of scientific development.

This summer, two leading young health law scholars, Professors efthimios Parasidis and Micah berman, will join the faculty, greatly enhancing our presence in the health law and policy field. Parasidis, an expert in health law, the regulation of medical products, and human subjects research, is currently on the faculty of the Saint Louis University School of Law. he consults for the American College of Physicians on conflicts of interest in the medical and pharmaceutical industries. berman, an expert in public health law and policy, tobacco control, and health- related litigation, is on the faculty of new england Law. he recently returned from a leave from teaching to serve as an advisor to the U.S. Food and Drug Administration's Center for Tobacco Products. Moritz students will benefit greatly from these exciting additions to the health law faculty.

The Ohio State University College of Public health provides law students with two joint- degree opportunities, one leading to a J.D. and a Master's Degree in Public Health (M.P.H.) and the other leading to a J.D. and a Master's Degree in Health Administration (M.H.A.). Both the M.P.h. and the M.h.A. programs at Ohio State are highly ranked nationally. graduates of these joint-degree programs will be prepared for leading positions in law firms, employment as counsel to health care organizations, management of health care delivery, and policy- related positions in the public and private sectors. Select students enrolled at the medical school also can earn a joint J.D./M.D. through Moritz and The Ohio State University College of Medicine.

The health Law Society aims to educate students of the law school and campus communities about the medical-legal issues which affect health care providers, patients, and legislators. The group hosts lectures and events throughout the school year.
