Labor and Employment Arbitration Today: A Midlife Crisis or New Golden Age?

Professor St. Antoine will leverage decades of academic and practice experience to discuss the current state of labor and employment arbitration. In recent years, there has been a greater focus on employment arbitration due to the sharp decline in union membership and the increased use of mandatory arbitration by nonunion employers. St. Antoine’s presentation will address the pros and cons of these arrangements and their evolving legal regulation, and suggest best practices to maintain the substantive claims of employees and the due process rights of all parties.

The Schwartz Lecture on Dispute Resolution was established in 1992 as a result of the generosity of the late Stanley Schwartz Jr. ’47 and the Schwartz family. Each lecture is published in the Ohio State Journal on Dispute Resolution, in keeping with Schwartz’s interest in the promotion of scholarly publication in the area of dispute resolution.
