Lindsay Nichols (’13) and Kevin Stanek (’13) Co-Author Article on Labor Law in Charter Schools

As part of their 1L summer internship at the Ohio Alliance for Public Charter Schools (OAPCS), Kevin Stanek (’13) and Lindsay Nichols (’13) began the research that would turn into “Public Schools, Private Employers? A Closer Look at the Labor Relations of Public Charter Schools”, which the pair co-authored with Stephanie Klupinksi, the Vice President of Government and Public Affairs at OAPCS. The article was published in Volume 32 of the Illinois State Education Law & Policy Journal.

In their piece, the authors examine a case that arose at a Chicago charter school, the Chicago Mathematics and Science Academy, asking whether teachers’ attempts to unionize fall under the jurisdiction of the Illinois Educational Labor Relations Board or the National Labor Relations Board. At issue is whether the school could be treated as a political subdivision, and whether that is because it is an administrative arm of the government or because it is a body responsible to public officials or the general electorate. If the school is a political subdivision, then it is exempt from the National Labor Relations Act, and state law would govern any labor relations at the school.
