WELCOME The Ohio State Journal on Dispute Resolution is pleased to bring you Volume 3, Issue 1 of The Mayhew-Hite Report on Dispute Resolution and the Courts . LEAD ARTICLE Professor Sarah R. Cole discusses mediator certification in her article entitled "Mediator Certification - The Time has Come?." She addresses the Association for Conflict Resolution's mediator certification plan, as well as Florida's court mediator credentialing program. This brief article reviews the components of mediator certification programs and assesses whether such programs will benefit the mediation field. The full-text of this article can be accessed here. ARTICLE SUMMARY The following law review articles: Bobbi McAdoo, A Report to the Minnesota Supreme Court: the Impact of Rule 114 on Civil Litigation Practice in Minnesota, 25 Hamline L. Rev. 401 (2002) and Bobbi McAdoo & Art Hinshaw, The Challenge of Institutionalizing Alternative Dispute Resolution: Attorney Perspectives on the Effect of Rule 17 on Civil Litigation in Missouri, 67 Mo. L. Rev. 473 (2002), provide an interesting assessment of lawyers' perspectives on the use of ADR in Missouri and Minnesota. A detailed summary of this law review article can be accessed here. CASE SUMMARY In Goodyear Tire & Rubber Co. v. Chiles Power Supply, Inc., 332 F.3d 976 (6th Cir. 2003), the Sixth Circuit emphasized the importance of confidentiality in settlement negotiations, finding that exceptions to confidentiality requirements occur only in rare circumstances and require a significant showing of proof. STUDENT SPOTLIGHT An issue often debated in the ADR community is whether having a legal education should be a prerequisite for serving as a mediator. While some critics argue that having a law degree should be a requirement for serving as a mediator, Matthew Daiker, a recent graduate of The Ohio State University Moritz College of Law, in his paper entitled "Despite Challenges, Non-Lawyer Mediators Make Critical Contributions to the Field of Mediation" provides an interesting discussion of this issue, concluding that a legal education is not necessary to be an effective mediator.
