News on the Oral Argument for Citizens United

The oral arguments for the case of Citizens United v. Federal Election Commission are set for Wednesday, September 9, and information on the hearing has been leaked thanks to the SCOTUS blog.  This will be the first hearing for Justice Sotomayor, with plans to provide the audio of the argument shortly after the hearing.  For more discussion on this case, see Edward B. Minnesota DFL party files FEC complaint against Norm Coleman

A new conflict has arisen in relation to the Minnestoa Senate race.  The DFL party has filed a complaint against Norm Coleman for allegedly not adhering to campaign finance rules during the recount.  The complaint requests that the FEC investigate its claims of possible violations of FECA and BCRA and fine the Coleman campaign if there has been any non-compliance.  The complaint also seeks to enjoin any non-complying activity that might be discovered.

Line-drawing after Overruling Austin

The overruling of Austin would not automatically signal the end of congressional limits on electioneering by business corporations. Instead, it would just mean that the fight over the legitimate scope of those limits is about to get underway.

Citizens United, Stare Decisis, and Democracy

In reading the amicus brief in Citizen United filed by the congressional sponsors of the McCain-Feingold law, I am struck—and impressed—by the candor with which they address head-on the “vehement[] disagree[ment]” that some Justices have towards Austin and McConnell.  Any defense of these precedents, which would prevent their overruling, must convince a Justice of the obligation to retain them despite this vehement disagreement.

Austin developer, corporations, indicted in election law case

An Austin-based developer and two corporations were indicted by a Travis County grand jury Friday, accused of illegally using corporate money to influence a 2006 recall election in Cibolo, a San Antonio suburb.

FEC fines Martinez $99,000 for breaking election law in 2004

Sen. Mel Martinez of Florida has agreed to pay $99,000 in fines for breaking several federal election laws -- including accepting $313,000 in excessive contributions -- during his 2004 campaign, according to newly-released records.
