What Court Would Hear a Presidential Contest?

State supreme court

Maine law does not authorize Presidential election contests as such (previous statutes have been repealed). However, Presidential recounts are allowed and, if they result in enough disputed ballots to affect the result of the election, the state Supreme Court will determine the result. M.R.S.A. 737-A. Supreme Court justices are appointed by the governor for 7 year terms. Maine Const. Art. 6, § 4.

Who Performs Presidential recounts?


Automatic recounts are performed by Secretary of State staff, while candidate-initiated recounts are performed by representatives of candidates under the supervision of the Secretary. 21-A M.R.S.A. s 737-A; ME ADC 29-250 Ch. 501, s 5. The Secretary of State is elected by the state House and Senate. Me. Const. Art. V, Part 2, § 1. Candidates who have not requested a recount may attend the recount if they so desire. 21-A M.R.S.A. s 737-A.
